LeapVPN (“we,” “us,” or “our”) provides proxy services, Wi-Fi security, authentication, and encryption services (the “Services”) to you, the user (“Client” or “Subscriber”). By using our Services, you agree to these Terms of Service (“Terms”). Your continued use of the Services or the website constitutes your agreement to be bound by these Terms.
NOTE: THESE TERMS INCLUDE A BINDING INDIVIDUAL ARBITRATION AND CLASS ACTION WAIVER PROVISION, WHICH AFFECTS YOUR RIGHTS. PLEASE REVIEW THE SECTION ENTITLED “BINDING INDIVIDUAL ARBITRATION” CAREFULLY. YOU HAVE THE RIGHT TO OPT OUT OF THESE PROVISIONS BY FOLLOWING THE INSTRUCTIONS PROVIDED IN THE “BINDING INDIVIDUAL ARBITRATION” SECTION.
ACCEPTANCE AND REGISTRATION
By accessing or using the LeapVPN Services or website, you accept and agree to these Terms. If you do not agree with these Terms, you must not use our Services. These Terms include any order forms or subscription pages associated with the use of the Services, which specify service details, subscription periods, and applicable fees (“Order Form”).
LICENSE
LeapVPN grants you a limited, non-exclusive, non-transferable license to use our Services for your personal, non-commercial use, subject to your compliance with these Terms and any additional agreements or documentation related to the Services. All intellectual property rights in the Services remain the exclusive property of LeapVPN. You are prohibited from copying, distributing, modifying, or reverse-engineering any part of the Services unless explicitly authorized.
CONDUCT
You agree to use our Services lawfully and refrain from engaging in any activities that:
- Violate any laws or regulations, including spam or unauthorized access to systems.
- Exploit or distribute illegal content.
- Infringe upon the intellectual property rights of others.
- Interfere with or disrupt the Services or the experience of other users.
- Perform unauthorized scanning, testing, or attacks on any system or network.
BREACH
Violation of these Terms may result in immediate suspension or termination of your access to the Services without refund. LeapVPN reserves the right to pursue legal remedies or report violations to law enforcement if necessary.
SERVICE LEVEL AGREEMENT
LeapVPN will make every effort to ensure uninterrupted access to the Services, but we do not guarantee availability, speed, or quality. We reserve the right to impose limitations, cancel the Services, or make changes without notice due to technical or external factors. LeapVPN is not liable for any losses due to Service interruptions or failures.
CLIENT RESPONSIBILITIES
As a Subscriber, you are responsible for maintaining the confidentiality of your account, limiting your connections to no more than the allowed number, and ensuring the accuracy of the information you provide. You are also liable for any actions that occur under your account.
FEES
Subscription fees for the Services are charged as specified in the Order Form or at the time of purchase. LeapVPN reserves the right to adjust fees at any time. Payment obligations are non-cancellable and fees paid are non-refundable unless otherwise stated.
NO WARRANTIES
LeapVPN provides the Services on an “as-is” basis and disclaims all warranties, whether express or implied, including those of merchantability and fitness for a particular purpose. We do not guarantee that the Services will be free of errors, uninterrupted, or secure.
LIMITATION OF LIABILITY
In no event will LeapVPN be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use the Services. Our total liability under these Terms is limited to the amount paid by the Subscriber for the Services.
INDEMNIFICATION
You agree to indemnify, defend, and hold LeapVPN harmless from any claims, damages, liabilities, and costs arising from your use of the Services or breach of these Terms.
ARBITRATION
If a dispute arises between you and LeapVPN that cannot be resolved through negotiation, it will be settled through binding individual arbitration in accordance with the terms outlined in this section. You may opt out of arbitration within 30 days of accepting these Terms by providing written notice to LeapVPN.
SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
GOVERNING LAW
These Terms are governed by and construed in accordance with the laws of United States, without regard to its conflict of law principles. Any legal disputes will be resolved exclusively in the courts of United States.
CHANGES TO TERMS
LeapVPN reserves the right to modify these Terms at any time. Any changes will be effective upon posting on our website. Continued use of the Services after changes have been posted constitutes acceptance of the updated Terms.
